What is Indefinite Leave to Remain (ILR)?

For foreign nationals, Indefinite Leave to Remain UK (ILR) is a type of settlement.


In most cases, you must have lived in the UK for at least five years before you may apply for Indefinite Leave to Remain, However, in some circumstances, you can do so after only three or even two years.


Innovator, spouse, and skilled worker visas are just a few of the immigration visas that might result in ILR.


One can live in the UK without any limits with Indefinite Leave to Remain, which is the first step toward registration and full citizenship.

What are the UK Indefinite Leave to Remain Eligibility and Requirements?

Depending on the individual circumstances of the applicant, including the type of visa they possess, the specific requirements vary.


To qualify for Indefinite Leave to Remain UK, you must have lived legally in the UK for a specific amount of time. However, there are other requirements that must be fulfilled.


The following criteria must be met in order to be eligible to apply for Indefinite Leave to Remain:


  • living lawfully in the UK for a particular period of time.

  • No criminal record, no violations of immigration regulations while you were a resident of the UK.

  • During the qualifying period, any time spent outside the UK must not total more than 180 days in a calendar year.

When Can You Apply for ILR?

You will need to provide proof of qualifying residence for either 2, 3, 5, or 10 years, depending on your immigration status.

Indefinite Leave to Remain Fees

An application for Indefinite Leave to Remain UK currently costs £2,389 per person. ILR rates from 2021 will remain unchanged in 2022.


Additionally, it costs £19.20 to register biometric data, which is required for submitting an ILR application.


The whole application fee of £2389 must be paid by your dependents if you are applying with your family.


If you require a speedy response to your application, an advanced option is also offered. A further £500 will go toward processing your application through the priority service, which takes five working days, and a further £800 will go toward processing it through the super-priority service, which takes one working day.

Documents Required For Indefinite Leave to Remain UK Application?

It's crucial to remember that the documents you submit must be original issues. You must provide a justification if you are unable to present the original paperwork.


Typically, you'll have to supply the following records and details:

 

  • Travel documents, such as a passport and any previous passports that were valid while you were in the UK,

  • Certifications of birth or adoption

  • Travel paperwork and other records that detail any time you spent outside the UK while residing there

  • If you were forced to register with the police when you arrived in the UK, a police registration certificate

  • Your immigration history

  • Financial data, including bank statements

  • Get a UK Life Certificate by passing the test

  • Pass certificate (if not excluded) demonstrating B1 English proficiency

  • Two passport-sized photos that are the same
